our agency was suppose to email or call us back yesterday (thursday)- they didn't So I sent them an email late thursday night demanding we get a call or just an email. On Friday.
So Friday at 1:10pm they emailed- and said-
"We just heard from Dr. (facilator) and he said that the Power of Attorney was "officialized" on July 2,2003. and they cannot put the file into PGN.
Based on the email from Dr. (X) he says that he is not sure that the social worker's report may not be acceptable to PGN. This of course, further confuses us as to where your case is as this makes it appear that your case was in Family Court this entire time. Someone from the agency is going to write back to him and find out what exactly this means."
WHAT A ROLLERCOSTER of EMOTIONS- so what does this mean?
the court system in Guatemala is trying to take all the adoptions- and not have any lawyers or agencies invovled- anyone after June 30th probably will lose their referral and would have to get one through the Central Authority (same as PGN) and now the cases start in Central Authority- then go to Family court and have DNA done then. (what us embassy website says anyway) So, we don't know if we lost him- or what- this email sounds like we were in family court and maybe he had a POA for that court- and didn't file in PGN the POA like a lot of facilators didn't do because they wanted to wait and see. (which now has caused a lot of problems) So I emailed back and asked- if we would have to wait all weekend like last weekend from HE double hockey sticks. but no answer at the agency (it was 5:00) and no response to the email- until 5:58. We recieved another email from the agency-
stating-" This is the director and I just happen to be here late today. The worker just received an email from Dr. (X). I called her on her cell to "read" it to her. It is still difficult to decipher but it appears that you ARE in Family Court but cannot be put into PGN until Dr. X knows what they want. THe worker will call him again on Monday so taht she can once again get more info. Director"
supposibly he had left his cell phone at home- so his wife took the message this afternoon-
All we want to know- or what we're praying for it that he filed a POA in family court- and we are done- but couldnt' be put into PGN (Central authority) because we don't have the new regulations they (pgn) want- like the psychological evalutation. So taht once we have that- they can summit it and we can go through PGN and get JOEL home already. They also will have all the cases now stay for 15 days when picking up children- which is FINE- both are- quick fixes- at least he'll be coming home-
ANYWAY- this is what we're hoping the mix up is all about- the new regulations- and that we're out of family court- or almost out of family court- since we were told by the facilator's sister and mother back in June we have been in family court since APRIL- when we went to visit him.
We also got an update- he's 20lbs now and 79cms (I think) he's 8 months now- just want HIM HOME....

I am so sorry that things are working out the way they have. I agree that you should keep knocking on heavens door with prayer for baby Joel. He needs you guys as much as you need him.

Prayers and Hugs your way until you hear a reply! I'm so sorry you're having to go through this, on top of an already emotional rollercoaster of a process, and that it is taking time away from getting Joel HOME. Keep after the agency for info and clarifications, you're doing the right thing in that regard. This is YOUR case and YOUR son, no one will fight for it or has as much stake in it as you (& DH) do.
i am new here, but i went back and read up on your sotry. i'm so sorry this is all happening to you. i will keep you and your sweet baby boy in my prayers!i hope things get fixed quickly and he is home with you soon.
Oh Jen!! I hope you hear some good news soon!! In the meantime, we'll keep saying prayers and keeping you all in our thoughts. I hope Joel can be home in your arms real soon!!
