Thread: My complaint and the medical board...

  1. #1

Angry My complaint and the medical board...

Well, BAH to the Maryland Board of Medicine!

From their decision letter (I filed my complaint a year ago):
"While different decisions might have led to a different outcome, we cannot find that Dr. Yu was responsible for your son's death."

They didn't address the whole making me deliver through a cerclage thing at all! Godd@amn it!

Well, since doing this the RIGHT way didn't work, who's up for a midnight firebombing?

Seriously, this threw me for a tailspin. He was so obviously incompetent that I expected them to do something. I'm beyond upset right now.

Do you have to go through the medical board? I mean, could you just sue him and take him to court?

Hugs. Don't know what to say. Can you give a man some sort of cerclage? Maybe then he'd understand a bit more about it.

hugs viv. even if nothing happens, i give you props for writing the letter and at least trying to do something......if you remember, i was encouraged to induce labor due to ruptured membranes, which i later found out may not have even been ruptured (i think the dye came out my urine, not vagina)......also, i was told the lungs wouldnt develop after a rupture, but they failed to tell me that isnt the case if you are only leaking. anyway, i didnt do anything about the incorrect information i was given that may or may not have caused my loss. you deserve credit for fighting for rivi, and for trying to hold the doctor accountable for his actions. if nothing else, i sure bet he will be super careful in the future with other patients!

Gosh, what a shock I'm sure. Maybe he has some "friends" on that board......

I'm not completely up to date with your story on this subject, but were you able to find out if there were other complaints against him?? In WI if any complaint has been made against a doctor, regardless if the board of Medicine upholds it, it is public record.

Like PP have asked....any other recourse??

Viv, I'm so sorry. I'm so mad for you right now!! I can't believe they won't do anything!!!

"While different decisions might have led to a different outcome"- how does this not say he was wrong? Idiot people.

I couldn't imagine some of the crap I hear you guys say your doctors said. I've never heard anything so stupid.

    I'm so sorry again.

Thanks, everyone. We thought about suing, but without a negative medical board decision, we'd need really hard evidence that he did something wrong. And it's just not there. Mommy's intuition and common sense aren't enough, unfortunately.

The sad thing is that, when I went to the hospital for my Dominici cerclage, the nurses asked me about Rivi, and when they found out who the OB was, they all said things like they weren't surprised! So he's apparently been incompetent before. Hopefully no other babies have died, though.

    Viv,

    This just burns my biscuits!!

If possible (for closure) I really think you should write back to the medical board and tell them that their cavilier (sp?) response to your complaint is unsatisfactory. I would ask them where is it written that you can delivery a baby through the vagina with the cerclage still in place. Because in all the medical books that you have read, and now with the experience of having a live baby, you now know that a cerclage must be removed prior to delivery....something that this incompetent doc failed to do.

This doctor obviously talked his way out of it with the medical board. I would also ask them to release their findings for you to look at ... since it concerns you, you should at least be able to see what he submitted to the medical board.
