Default ?'S On Adoption

Dh and I are planing to adopt a baby from Mexico. My dh aunt know a girl who wants to give her baby up for adoption, and is concidering us. We plan on using our vacation days from work for our trip over there. But I wanted to know if it all falls through and we bring our baby home, is a job required to give personal leave so i can bond with my baby and if so for how long?

Have you talked to a lawyer about adopting from Mexico? It is very rare that Mexico will allow an adoption by a US citizen. It is so sad that so many children are in need in Mexico but they are so resistant to us adopting.

Regarding the personal leave... I think that if the employer has 50 or more employees they have to hold your job and give you up to 6 weeks leave if you adopt. I am not positive on this law tho. Again something you would need to discuss with your employer and lawyer.

Here is some info I found on Mexican adoptions;

Mexico allows U.S. citizens and other non-Mexicans to adopt Mexican children. U.S. citizens who wish to adopt a Mexican child must adopt the child in Mexico in accordance with Mexican law. To qualify for adoption, the child must be an orphan. This means the child must be orphaned, abandoned, or have one surviving parent who releases the child for adoption. Under Mexican law, foreigners may need permission from the Secretary of the Interior (Secretaria de Gobernacion) to adopt in some states.

FY-1996: IR-3 Immigrant Visas issued to Mexican orphans adopted abroad - 94
IR-4 Immigrant Visas issued to Mexican Orphans adopted in the U.S. - 0
FY-1997: IR-3 visas - 157, IR-4 visas - 3
FY-1998: IR-3 visas - 167, IR-4 visas - 1
FY-1999: IR-3 visas - 134, IR-4 visas - 3
FY-2000: IR-3 visas - 104, IR-4 visas - 2

Well i'm hoping i will be blessed.

My dh family is from Mexico, and his aunt said that it is not dificult. She said a couple just adopted a little baby boy from there. I guess it's alot easier if you know the language culture and country. At least that is what i'm told.

I have not been fortunate to find an attorney from Ca. that can give me info. reg. adoption in Mexico. No one here is much informed about it.

My dh aunt did say that if the lady conf. she will give us the baby I will need to have a lawyer there in Mexico make the finalization's for adoption there.

Luckly my mom has a dear friend in Taxas who is a lawyer for imagration. She also has adopted three children, I don't know from where though. But I am going to talk to her tonight and see if she can answer some of my ?'s

As for my job ,I feel that there being a little selfish. They don't really like the fact that I want to take time off if i bring the baby home. They understand i would want to bond w/ the baby and that it will be an emotional expirence. But they said they really need me working.
They know by law they will need to give me the personal time, they just don't know how much is required and of course neither do I. My supervisor told me he would be willing to give me three weeks, just as long as it is not during holidays when it's really busy. Yha right like I can really decide when the date will be. This just fustrates me.

If your company has more than 50 employees, they are required to follow the federal Family and Medical Leave Act.... That law guarantees 90 days of (unpaid) leave after the birth OR ADOPTION of a child.
