Default Soooo sorry it's long .... Need advice...

Cysters I need advice, PLEASE! I had a m/c & D&C 5~26~04. Since then I have been VERY depressed (Well my water broke 5~24~04) Well I have been off work from 5~24~04 until 6~28~04 (per Dr's orders I was put on Family Medical Leave) Needless to say we didn't have money for our June rent. When DH explained our problem as to why we didn't have ne money the landlord said she "understood" and knows it take about 2 months to get a check from the insurance company. Dh told her when I get back to work my first two checks will go to them for rent for June and July (or the check from the ins. co. what ever came 1st) Monday (my 1st day back to work) we came home to fine a notice that they filed for eviction (SP?) Today we got good news that we can finaly "buy" our own home!!! THen we came home and found papers taped to our door and some in the mail box... We have to go to court for non~payment of rent. Now I am not saying that we don't owe them money. We do and now it is for 2 months (June and July) But the lady should not have led us to "think" she would work with us. She should have told us what she was going to do. I have soooo much stree I feel like I am going to loose my mind!!! I know there is nothing anyone can do for us but I needed to get this out!

Is there anyway you can talk to your landlady before you go to court? Ask her why she said you had time? Tell her you know you owe her money, but she said she'd work with you all, and pay her as soon as you can? Can you pay her now? Keep anything in documenation you have--and make sure to tell the Judge you're story..hopefully he'll be able to tell you're not lying like Judge Judy . But.. I think if you can charm the landlady..it would be the best thing to do!! Good luck.. if you find out from talking to her, that say, she's done this on purpose, so she can get money out of you, just saying its okay to pay late, maybe a cheap lawyer would be in order....many law offices let you call free, and talk to a lawyer, free to see if they can help you. Always get everything in writing ladies!!!! Then there is no room for miscommunication. If there was a notice on the door stating who the attorney is then you have to contact the attorney instead of the landlady (thats the law). The most important thing is to contact them and make payment before they go to court- attornies fees can be added to your bill. You might also want to check the phone book for Legal Aide Society- this is a service to the community that has lawyers who give advice to people who don't have the money to afford one.

I am so sorry you have to go through this mess.

okay don't panic.
I do this for a living (help people facing eviction)

I don't know what state you live in, but i'm assuming you recieved a "pay or quit" notice at some point,

then what you just got is an "unlawful detainer notice" which means you go to court.

IT IS IMPERETIVE THAT YOU GO TO COURT.
if you don't go to court you will automaticaly lose and be evicted.

As long as you go to court, if all goes well, you just say "no i don't owe the meonty" (i know you do) then they schedule a hearing, that's a couple of weeks from the court date.

THEN you go to court they find against you (if you owe the money) and usually you have ten days from then to appeal before they can call the sherriff and put up a 72 hour notice.

so this is about 6 weeks from now.

my advice is
A) GO TO COURT
B) if you dont' have the money to pay the rent, call local faith based charities and the salvation army and explain the situation, they will often help with a months rent or so,.

okay, i know that may be hard to do, people have trouble asking for help but help is there becaue you need it. wand when you're in a position to help, go ahead and help others, then it all works out.

I understand your conceern and panic. and congrats on getting approved on buying a house. now what you need to do is buy yourself some time while you find a house and close on it.

btw, i am sorry for your loss and i i'm not ignoring it, i'm jsut looking at the part i know how to offer help with.

also, talk to your landlord, explain explain explain, hiding has NEVER helped anyone from my experience.

Hi and thanks for the reply! We did go for a hearing on July 13th and it was "dismissed w/o prejudice" because she didn't give us the 5 days it says in our lease. (She gave us a writtin notice on June 26th and then filed on the 28th) So her lawyer set up payments with us and we have to be out but he end of the month. The district justice also at the end of the hearing told my dh and I he was very sorry for our loss and it being the reason for us falling behind. Our landlord knew our reason for us not haveing the money and agreed to work with us ... but wanted the rent in full at one time. Then BOOM notice on the door. But that part is behind us. Now we can stay w/ our parents but we have to find someplace for our fur baby... both our parents have animals and Simba can't go there oh well we will deal with that in time. but thanks again!
