Just wanted to give you guys a heads up. We tried to file our taxes at the end of January but found that we needed an ATIN (adoption tax id number) to claim ds, as his adoption isn't final. That form was recieved by the IRS on Feb 9th. Here it is, April 14th and we still don't have the ATIN!!! I called today, spent 2 long and miserable hours on the phone trying to find out where our number was. Turns out, it's still in the computer!!! They haven't processed our paperwork yet! The girl I spoke to said that the IRS's primary concern is for tax ID numbers and not ATINs, as they are "far and few between". Hello??? You can't tell me that there aren't a bunch of people who are in the same boat as we are, waiting to finalize, but needing to file taxes prior to finalization!!! She said that she would send a print out to the clerk about getting us a number, but it wouldn't be to us in time to file our taxes by the 15th. So now we have to file an extension or file our taxes and then do an amendment with ds's info later.
It's all totally ridiculous! If we owed money, you can bet they'd be all over us for not paying. Now that they owe us money, they are dragging their butts to not get us a number!!!
So, if you adopt this year and don't finalize before the end of the year, send off for you ATIN immediately after your child is placed with you!!! It says it takes up to 6 weeks to get the number. We're at 60+ days....by the time we get our ATIN, ds's adoption will be final and we can submit for a SSN.
What a load of crap. I am so pissed and there is absolutely no recourse for us right now. I mean, even if we do complain, I'm sure the complaint will be placed in the circular file!!! UGH!!!

You and I have such parallel situations it is kind of scary at this point but cool. Ok same thing happened to us our accountant asked for the ATIN and I had no idiea what he was talking about, so I called the agency and they had no idea either. In any event my accountant sent me the form we filled it out and sent it in to the IRS . I called the IRS 1040 number every week until they gave me his ATIN and the we filed our taxes last week.
So we were pissed as well. If we had known when Sam came home we would have done it. It held our taxes back by 2 months. Plus we are getting a large refund back so of course we have not seen that yet because of the delay!
You should call back and speak to a supervisor or another agent and get to the bottom of it. That girl you spoke to does not sound like she knows what she is talking about! If they have it for 60 days demand answers! They gave us our ATIN on over the phone, I still have yet to see something from the IRS with the ATIN on it. But the agent said if it is in the system we can use the number! Ask them for the number, if it is in the system they should have the number, that is how we got it, it was in the system.
You should not have to file amended taxes just an extension, that is what we did, an amended return is the biggest pain the arse!

I'm still fuming about this!!! Evidently, our stuff is in the computer, but it hasn't been assigned a number!! There really is nothing we can do about it at this point, as tomorrow is tax day. I'm just so friggin' frustrated about the whole thing!! I think we are just going to file for an extension instead of the amendment. AT this rate, we'll have a SSN for ds before they have the ATIN for him.
I tried to get them to give me the number over the phone, but evidently, the lady I spoke with would have had to get off her butt and go to another office, speak with someone there and have them assign us a number. Can't possibly ask anyone to go out of their way to correct a problem they caused, can I? Ugh. So frustrating. At least I'll know next time around to get an ATIN immediately!!!
Glad you got yours, Tricia....we have a decent refund coming to us and now it's delayed because of this.....sigh.

I hear you loud and clear! We are in the same boat! You know it will be easier to get the SS with the ATIN from what they told me. So maybe that is one plus.
I would definitely stay on them and hopefully you will get someone nice on the phone that will help you. I am sorry you are so frustrated, I wish I had posted when it happen to us and you would not be going thru this now!
Just file the extension, and you should be fine. Hopefully the number will be in the system in the next few days! I will keep my fingers crossed for you!
If I had know I would have our refund back already, uuugggghhhhh it really annoyed me too. I felt so bad that I did not know about the ATIN with all the research we did. At least now we both know for next time!

Spooky I am not responding about the IRS but I just want to say you DS is beautiful. Where did you adopt him from? I just can't imagine someone giving up such a beautiful baby but for you I am glad they did. Wish you the best of luck
